Please read these Terms and Conditions carefully before booking and using FLX Turf indoor sports and training facility located in Canandaigua, NY (the "Facility"). By booking and/or using the Facility, you (the "User") agree to be bound by these Terms and Conditions.

1. Booking and Payment:

• Reservations: All rentals must be booked in advance through the designated FLX Turf booking system (e.g., website, phone).

• Booking Confirmation: A booking is considered confirmed only upon receipt of full payment or a non-refundable deposit as specified at the time of booking. FLX Turf reserves the right to refuse any booking at its sole discretion.

• Payment: Payment methods accepted will be outlined in the booking system. Full payment may be required a specified number of days prior to the rental date.

• Rates: Rental rates are subject to change without prior notice. The rates applicable to your booking will be those in effect at the time of booking confirmation.

• Taxes: All rental fees are exclusive of any applicable sales taxes, which will be added to the total cost.

• Overtime: Use of the Facility beyond the scheduled rental time may be subject to additional charges at a rate determined by FLX Turf. Any overtime must be pre-approved by FLX Turf staff if possible.

2. Use of the Facility

Use is limited to lawful, safe, and appropriate activities, including, but not limited to, sport specific practice, training, and other turf-related activities. User agrees to not use the Facility in a manner that interferes or disrupts other guests or organization’s use of the Facility.

3. User Responsibilities

User agrees to:

• Use the Facility only for its intended purposes (sports, training, fitness, etc.).

• Renters are responsible for the supervision of all individuals using the facility under their booking, including but not limited to team members, coaches and guests.

• Maintain established scheduling through promptly entering and exiting the Facility and allowing other guests to utilize their reserved time(s).

• Follow all posted rules and guidelines.

• Adhere to any instruction or direction regarding the Facility from FLX Turf (Owner).

• Wear appropriate attire and safety gear for the intended activity.

• Maintain respectful, courteous and responsible conduct toward Owner and other users and guests.

• Report any damages, issues or unsafe conditions at the Facility immediately.

4.  Prohibited Conduct

The following conduct and activities are prohibited within the Facility and on the property of the Facility:

• Smoking, alcohol, or drug use of any kind.

• Users will be refused admittance if suspected to be under the influence of alcohol and/or drugs.

• Verbally abusive behavior towards individuals, other groups, organizations, or clubs, including the use of profanity, shouting, name calling, vulgar, or angry language.

• Harassment or intimidation towards individuals, other groups, organizations, or clubs through words, gestures, physical behavior, body language, or any other actions.

• Theft of any of the Facility or other guest’s property.

• Unauthorized access to restricted areas. Restricted areas are those outside of the parking lot, sidewalks, entry way, and any locked area within the Facility.

• Bringing outside equipment without approval.

5.   Facility Policies

The following are policies and general guidelines of the Facility:

• Loitering within the Facility or on the grounds of the Facility is prohibited.

• Unlawful possession or carrying and concealment of any device or object that may be used as a weapon is strictly prohibited.

• No pets are allowed within the Facility unless they are house broken and professionally trained as a service animal.

• Users are not to make any alterations, adjustments, changes, or additions to the Facility or any of its materials, equipment, or structure(s) in any way.

• Sports activities are only allowed within the netted/playing area of the Facility and not in the transition/staging area of the Facility.

• The Facility is not responsible for items that are lost, damaged or stolen.

• Items left behind will be retained in the lost and found for one week, after which they will be discarded.

• In the instance of an emergency requiring attention from first responders, management/ownership of the Facility should be contacted to be made aware of the situation immediately.

• User acknowledges the Facility has interior and exterior security cameras as part of a closed-circuit video system in place to protect the facility from theft, damage, trespassing, and any irresponsible, unsafe, or illegal activity.

6. Hours of Operation

The Facility hours are from 6am to 11pm, Monday through Sunday. The Facility will be closed for the following holidays:  New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas.

7. Health and Safety

User warrants that as a user of the Facility they are physically capable and has no medical condition(s) that would prevent safe participation in User’s activity. User acknowledges that participating in sports, training exercises, cardiovascular activity, and other similar programs can be dangerous and pose health risks, especially for those who are not physically fit or have underlying conditions. In the case of emergency, User agrees that Owner may contact emergency services and/or emergency personnel.

8. Assumption of Risk & Waiver of Liability

User acknowledges that participation in sports and physical activities involves inherent risks, including but not limited to injuries, illness, and/or death. User voluntarily assumes all risks associated with use of the Facility.

To the fullest extent permitted by law, User hereby releases, waives, discharges, and covenants not to sue Owner from any and all claims, liabilities, damages, losses, costs, or expenses (including attorney’s fees) arising out of or related to any injury, illness, death, or property damage occurring at or in connection with the Facility or any of its programs or events. This release applies to any claims based on the negligence of Owner but does not apply to claims resulting from their gross negligence or willful misconduct as prohibited under New York law.

User acknowledges and assumes all additional risks and any danger that may result in property damage, physical injury, and/or death, which may be above and beyond any of the inherent dangers and risks of User’s respective activity, including but not limited to: falling, loss of balance, uneven surfaces, slick areas, or conduct by User that is negligent or unsafe.

User understands that the description of the risks in this Agreement is not complete and voluntarily chooses to participate and expressly assumes all possible risks and dangers of User’s activity and the possibility of personal injury, death, and any loss resulting, whether described here or not, known or unknown, inherent or otherwise.

User understands that Owner is not responsible for lost, stolen, or damaged personal property, and User assumes all risk of loss related to personal belongings brought onto the premises.

9. Damage and Liability

User is responsible for any damage caused to the Facility by User’s misuse or negligence of the Facility, excluding normal “wear and tear.” Owner reserves the right to charge for repair and/or replacement costs for any negligent or deliberate damages that are incurred. If damages caused by User’s misuse or negligence of the Facility prevent the Facility from operating, User may be liable to Owner for lost revenue. Owner reserves the right to permanently ban or expel any individual who is viewed (in person or via recording) purposely damaging the facility in a negligent, willful, or malicious manner.

10. Photography and Media

User grants Owner the right to use photographs, videos, and recordings taken at the Facility for promotional and marketing purposes, without compensation, unless User provides written notice opting out.

By proceeding with a booking and using the FLX Turf facility, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
